Chevron Deference (The FAAs current legal strategy to circumvent lawmakers)

The government in a case between the EPA and Chevron determined in the name of safety they could impose regulation without congressional legislation. The FAA has taken a page from the EPA’s play book and imposing restrictions without actual law being passed by states or Congress. They have basically created a situation where the use of Unmanned Aerial Systems (UAS) for commercial use is illegal despite the fact that there are no laws stating that it is. Being an advocate for state’s rights I believe that the states should be the entity to determine that laws on the use of UAS within their states and with the need for jobs throughout the country I would assume that uses for surveying, agriculture, oil and gas as well as mineral exploration. The FAA is using the excuse of public safety to make draconian restrictions on the commercial UAS industry. They are as well very inconsistent to whom they authorize and for what reasons.

They have given authorization to the Puma, the Raven and the Scan Eagle, UAS technologies utilized during the wars in Afghanistan and Iraq. Not saying that these systems are bad but they aren’t any better than many other commercial UAS technologies which are priced significantly more economical. Just as an example the Cyclops has four hour duration of flight with a five pound payload with a base price of $5,400. It is manufactured in China but that doesn’t minimize its flight worthiness or capabilities. When I was looking for the cost of the Scan Eagle I heard that the whole system cost over a million dollars. The best pricing I was quoted came from the supplier of Insitu camera systems who told me the base price is $150,000. AeroVironment is imbedded into the FAA and this is a clear conflict of interest.

States’ rights and Congressional authority has been just given up to a Federal Bureaucracy, stepping all over free trade and commerce in the name of safety, playing on the lack of technical prowess pertaining to this technology they have hijacked the rule of law in this country all in the name of public safety. Well let’s talk about safety. I just became informed of a requirement in the state of Florida to outsource controlled burning of range facilities for department of forestry using UAS technologies because it is not safe to have helicopters flying over the fire with the possibility of unexploded ordinance that could explode and cause damage to the helicopter and crew. This is an obvious safety benefit for the use of UAS. There are many other obvious safety issues for survey and inspection of high tension power lines, oil and gas exploration but the one that would seem most obvious is search and rescue, a situation that literally means life and death. What makes UAS the most obvious solution is the ability to stream the imagery to an analyst in front of a monitor scrutinizing the data, being able to slow it down and compare areas just days before where there might be a contrast which would give an indication that someone might have passed or some change in coloring due to discomposure indicating a body. Gene Robinson of RP Flight Systems is in the midst of a law suit with the FAA which will have a major influence on the industry and the US economy where there are hundreds of drone manufactures.   

The FAA is holding the industry captive with a combination of the Chevron Deference loophole in the name of “Safety” and for the development of sense and avoid technology is a capability to ensure that a drone doesn’t fly into something that it isn’t shouldn’t. Several systems are operational now that could be implemented, one is to use satellites to monitor a perimeter for UAS operation and monitor and alert the operator that a plane or helicopter is flying into the area of UAS operations. Another is mapping out corridors for UAS operations. Basically by designating the specific flight paths for UAS operations. Then there is the system the US Military has been using for over a century, not just for UAS or drone operations but for all missions in combat and training for shooting, demolitions, parachuting and diving. Planning, briefing on specific procedures and parameters and adhering to them strictly. No deviation or excursions into areas that are not part of the specific mission or tasking. These control systems are already in place and there are many military veterans who are familiar with this type of operations who are ready to fill the jobs that will be created in this new industry. I am sure that there are legislators in congress and individual states that can see the advantage of lifting the limitations of perceived “Safety” and open opportunity for employment.

Where is the money?

I wish Congressmen and State Legislators would read this, have clarity and declare that the FAA adopt common sense protocols and procedures but I can’t afford to hold my breath. Digging into the industries that UAS integration optimal I have found opportunities that aren’t dependent upon FAA authorization. I’ve talked to several UAS operators who specialize in Precision Agriculture and they are telling me that they don’t have solutions, they can find the problems with infestations, production estimates and determining the overall health of the plants but other than gathering the data, they don’t offer solutions.

Why am I a conservative Republican?

I've been wondering how people could be liberal, then I got to thinking about what made me conservative. Growing up on a farm with a socially liberal and fiscally conservative Democrat father and ultra liberal, Republican mother and a conservative Democrat Step Father I slanted Democrat with a strong free market bent. In 1980 I wasn't registered to vote but I would have voted for John Anderson the independent. Then I joined the Navy and I found I really liked what Ronald Reagan Stood for. I under George HW Bush I was very upset over how he handled the situation in Panama which caused the death of three of my SEAL teammates. I was so angry that I register to vote for the first time and voted for Ross Perot. I quickly realized the error in that decision. The military draw down began, there was no advancement and life became very uncomfortable. It wasn't until the year 2000 when I became aware of John Kerry was running for President and I remembered his testimony before Congress stating that our military service members were rapists and baby killers. I remembered my favorite uncle Leo getting spit on by protestors and there was no way I was going to let him be my President. I looked up the San Diego Republican party and gave them a call and they let me know when their precinct operations meeting would be held and I volunteered and started walking precincts.

Now there is no way I could imagine being a liberal or a Democrat and my reasons are purely based upon how uncomfortable my life has been under a Democratic President. every time they get into office my life gets very unpleasant. I want a true conservative, someone who calls it like it is and doesn't back down. My dream ticket would be some one like Daryl Issa, Governor Rick Perry or Trey Gowdy or Governor Scott Walker or Wisconsin. These men have a proven track record and resolve to go with it. Backbone is what we need and anything less is unacceptable.
